NightOps is a logistics management application that enables users to create Material Receipts (MRs), capture photos, generate PDF reports, and manage shipment records. The service is provided "as is" and "as available."

When you create an account with us, you agree to:

• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these terms.

The NightOps application, including its design, code, features, and content, is the property of BDM Digital Enterprises LLC and is protected by intellectual property laws.

You retain ownership of any data you input into the service. By using NightOps, you grant us a limited license to process, store, and transmit your data solely for the purpose of providing the service.

To the maximum extent permitted by law, BDM Digital Enterprises LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

- Loss of profits, data, or business opportunities
• Service interruptions or downtime
• Errors or inaccuracies in the service
• Any unauthorized access to your data

Our total liability for any claim arising from these terms or the use of our service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

The service is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties, express or implied, including but not limited to:

- Merchantability and fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of any content
• Uninterrupted or error-free operation

We may terminate or suspend your access to the service at any time, with or without cause, and with or without notice. Upon termination:

- Your right to use the service ceases immediately
• We may delete your account data after a reasonable period
• Provisions that by their nature should survive termination will remain in effect

These Terms of Service shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes by updating the "Last Updated" date and, where appropriate, providing additional notice.

Continued use of the service after changes constitute acceptance of the revised terms.
